ORDINANCE NO. 619
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE
CITY OF CLARION, IOWA, 2022, BY AMENDING CHAPTER 91: WATER
METERS
BE IT ENACTED by the City Council of the City of Clarion, Iowa:
SECTION 1. SECTION MODIFIED. Chapter 91: Water Meters of the Code of
Ordinances of the City of Clarion, Iowa, 2022, more specifically Section 91.06, is hereby
repealed in part and the following adopted in lieu thereof:
91.06 METER COSTS.
1. Installation. All meters will be owned and maintained by the City
water department. All meters must be the same type and from the same manufacturer used by
the City or approved by the City. The City shall either install the water meter(s) or approve
the installation of the meter by a licensed plumber prior to receiving water service. The
installation fee for meters will be set by resolution of the City Council. The City water
department shall have the final authority to determine the appropriate size of the meter based
on the service requested.
2. Meter Installation Fees. The property owner shall pay an installation
fee for every meter installed according to the fee schedule approved by the City Council prior
to installation. Property owners requiring a meter larger than a three-quarter inch meter shall
pay to the City, prior to the installation of any such meter by the City or an approved licensed
plumber, the additional costs for said larger meter.
3. Meter Deposits. A deposit, an amount established by resolution of the
City Council, will be required before any new meter installation or transfer of a current meter
for any new consumer is made. Said deposit is to be refunded upon the surrendering of the
meter and when all bills for water used, repairs, etc., are paid in full. In the case of the
consumer moving from one location to another within the City, and service remaining with
the same named consumer, the deposit will be transferred.
SECTION 2. SECTION REPEALED. Section 91.09 of the Code of Ordinances of
the City of Clarion, Iowa, 2022, pertaining to Meter Installation Fee, is hereby repealed. All
other parts of said Chapter shall remain in full force and effect.
SECTION 3. REPEALER. All ordinances or parts of ordinances in conflict with the
provisions of this ordinance are hereby repealed.
SECTION 4. SEVERABILITY CLAUSE. If any section, provision or part of this
ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the
validity of the ordinance as a whole or any section, provision or part thereof not adjudged
invalid or unconstitutional.
SECTION 5. WHEN EFFECTIVE. This ordinance shall be in effect after its final
passage, approval and publication as provided by law.
